I knew we would, since we were the ones who lodged the original complaint about Tevez and Mascherano in the first place.

I too support the board's decision to pursue this case. Clearly as Caborn said in an interview yesterday it would be better if the FAPL & the aggrieved clubs could sort out the affair internally without recourse to court action. However the track record of the FAPL is not very good & there's not much hope of them back tracking so it would appear that a challenge through the courts is the only possible solution.

End of the day West Ham have admitted to fielding an ineligible player, his contract & registration is still the subject of dispute & by fielding an ineligible player West Ham ipso facto have given themselves an unfair advantage to the detriment of other clubs who are playing by the rules.

In their recent verdict & decision to fine WHU the FAPL admitted that a points deduction would have been considered but for the fact WHU were involved in a relegation battle & also given a points deduction their 'great' fans would have been unfairly punished. Eh??

All this talk of matters being settled on the pitch is a mute point when you consider that one of the clubs ie WHU was fielding and may still be fielding an ineligible player, a player who now he's in form is having an effect on WHU's recent form & run of good results. Fact is he shouldn't have played because he was ineligible and still shouldn't be until such time that WHU can prove without a shadow of doubt that his registration & contact is above board & adheres to FAPL rules.

    THIS IS THE ANOMOLY
not deducting points so as not to "upset" west hams fans has just moved the upset to other fans in the relegation battle

    a truly mystifying statement

It's true that the investigating commision's findings & statements were condratictory ..

To summarise the Premier League's Independent Commission found ..

"This was not only an obvious and deliberate breach of the rules, but a grave breach of trust as to the Premier League and its constituent members. In our finding the club has been responsible for dishonesty and deceit."

The commission concluded that a deduction of points "would normally follow from such a breach of rules".

However they also stated "A points deduction so late in the season might have consigned the club to relegation. The players and fans of West Ham are in no way to blame for the situation and therefore should not suffer."

Mystifying. The Commision accepts that WHU broke the rules, states that a points deduction is the proper penalty then provides wholly unacceptable reasons why they, the Commission, have decided to not to foloow their own findings & punish the club as appropriate.

That is the biggest load of rubbish I've ever heard. Surely relegation is an incentive not to break the rules? :rolleyes

Maybe we should have fielded ineligible players, as we're obviously not going to get a points deduction as it could consign us to relegation.

You're right it is bullsh|t. It is clear that West Ham, due to the timing of the commissions findings have received favourably treatment. This in itself coupled with the the commission's statement that a points deduction is the 'normal couse of action' for such a breach of the regulations is the basis for possible court action by Utd & the other clubs.

Whether such a court action would succeed is another matter entirely however there is grounds for bringing a case given the contradictory nature of the commison's findings & statements.

Someone down the line has droped a massive bollock.

Theyve shot themselves in the foot saying it was too close to the end of the season to deduct points and if it was earlier they would have done.

We should just give it up, it's never going to work.

We should be back soon enough anyway, I want to see us win a few games in a season to get promoted to be honest.

    I agree.

    I disagree.

Theres no way in hell we will be reinstated, but it's really a matter of principal, even if it comes to nothing and we don't even get a single penny in compensation i'll still be happy with the board for persuing it.

The Premier League has messed this whole affair up, and if anything at least by us snapping at their ankles they might not be so incompetent next time for fear of someone else doing the same.

though being repreived would be nice , its a matter of principle
even if we dont get re instated , west ham should have the appropriate punishment. points deduction , even if it means a 19 team prem next season

and Brighton are now asking questions aboout tevez s ineligibility in the fa cup , and if proven want serious compo

It,s never been about re-instatement really, never much chance of that and we all know it.It is about compensation, and if we can cause as much chaos and as many problems as possible for those responsible while we are at it so much the better!
