Yeah, neither club have any responsibility for the players death. He was signed by Cardiff though, and they agreed to sign him for that fee, which is a separate issue that has been settled in court. It'd be a charitable donation for Nantes to let Cardiff off from any of the transfer fee, knowing that they will get and are entitled to the full amount (plus inflation). It's also quite a complicated issue as Bordeaux are owed half of any transfer fee. If Nantes and Cardiff were to hypothetically meet down the middle, Bordeaux would be legally entitled to half of the money and Nantes would be left without anything. And then there's the question as to why Nantes would feel charitable towards Cardiff. They've tried every tactic possibly to delay paying this fee, taken it to court after court despite losing each case, attempted to take out life insurance the day after his death and are now trying to sue Nantes for an amount that could liquidate their club. It'd also have to be on Cardiff to try and be willing to work with Nantes, given that Nantes are legally entitled to all of the fee, and they've never shown any willingness to do so as you can see with that statement.
What makes absolutely no sense to me, is that Cardiff City (stay classy guys) appear to have no basis for the action. They're suing Nantes for north of £100m despite it being evident Nantes weren't responsible for the arrangements of the flight that resulted in Sala's death. So what's the logic of their claim that Nantes owes them this amount of money? Is it a disagreement with the decision that they owed the transfer money and have been forced to pay it? Maybe I'm missing something but surely the case would be laughed out of court if the subject wasn't so tragic. Seems to be absolute nonsense to me and little more than another nail in the already ****ed up coffin of Cardiff's image.
the reality is cardiff are one spot about relegation yeah? the transfer ban was lifted by fifa cos cardiff paid the first instalment of the fee to nates. the efl ban is still in place. If cardiff fail to pay Nantes on the agreed schedule then fifa should reinstate its ban on all transfers and in effect assure relegation next year.
Well all parts of fee thst would come due yes. I don't know the breakdown so as sad as it was if there's appearances or performance clauses they cannot be met. just trying to play it down the centre and say pay your dues Cardiff. does anyone know the breakdown of the 18mil?
Cardiff should pay the money, and Nantes should place it straight in the bank account of the player's family.
The argument is that those that organised the flight were doing so on behalf of Nantes, and therefore Nantes were responsible and liable for that fee. It's not going to go very far, as none of those people were employed by Nantes, and Sala wasn't their player. There's a reason they initially tried to argue he wasn't their player, rather than going down this route. It's just three flat installments, but that figure is rising with inflation. After inflation, the first installment that has been paid was believed to be £7 million. With add-ons and bonuses it's never guaranteed money, and Nantes have to and have accepted that.
No. Cardiff have been ordered to pay the rest of the fee, that's been settled and there's no getting out of that now Cardiff are now suing for £100 million+, to get their initial transfer fee back and the money they'd have generated had they stayed up.
“BREAKING: Cardiff have been ordered to pay the entire transfer of Emiliano Sala to FC Nantes! FIFA ordered the Welsh club to make the last two payments totalling €11m to Nantes to make up the full €17m “ [@lequipe] GOOD!!
Meanwhile, In another development: Yesterday the CEO of FC Nantes, Franck Kita, was placed into police custody alongside Bakari Sanogo and Joaquim Batica by the JIRS, French prosecutors specialised in organised crime and financial crime. A judicial investigation was opened in June 2022 on the counts of "illegal exercise of sports agent activity, forgery and use of forgery, misuse of corporate assets, laundering of aggravated tax evasion and organised money laundering". The Club's negligence claim in France against FC Nantes exhibits direct exchanges showing Mr Kita was informing Mr Sanogo of the proposed transfer fee for Emiliano Sala. It is not clear why. In the circumstances, the Club considers that it would have been fairer if the requirement to pay FC Nantes had been deferred until the conclusion of the French police investigations and the club's claim against FC Nantes in the French courts. So basically just be more waiting around and appeals which you can kind of understand I guess if there are police investigations going on.
Cardiff City has been ordered to pay Nantes the transfer balance for Emiliano Sala, who died in a plane crash before he could play for the Welsh side. The BBC has been told that Fifa has told the Championship club to pay more than €11m (£9.45m). That covers the last two instalments of the €17m agreed between the clubs. Meanwhile, French prosecutors have confirmed several employees of FC Nantes have been arrested. That is as part of an investigation into money laundering and tax fraud. In a statement, Nantes public prosecutor's office said the FC Nantes club manager, his deputy general manager and two people, including a players' agent, were placed in police custody but have since been released pending an investigation. Cardiff failed in its appeal to the CAS over the Fifa ruling, and in January paid the first instalment, believed to be around £7m, of the Sala fee to Nantes. Fifa then lifted a transfer embargo. On Friday, the club issued a statement confirming the decision by Fifa they should pay the final two instalments. But it questioned the timing of the Fifa ruling, saying: "It would have been fairer if the requirement to pay FC Nantes had been deferred until the conclusion of the French police investigations and the club's claim against FC Nantes in the French courts." Separately, French investigators confirmed on Friday they were investigating employees of FC Nantes over a number of charges including: Illegal exercise of the activity of a sports agent by a national of a member state or party to the agreement on the European economic area Forgery and use of forgery Misuse of corporate assets Laundering of aggravated tax fraud Organised gang money laundering Philippe Astruc, district attorney for the Court of Justice of Rennes said: "The French Football Federation has instituted civil proceedings before the investigating judge, as part of its mission to regulate the activity of sports agents in the discipline of football and to defend the moral and material interests of French football. "The investigations mainly focused on the analysis of contracts, bank accounts and financial flows, with analysis of the numerous documents seized during the search. Cardiff City: Football club told to pay Sala transfer balance
In keeping with every other piece of classless avoidance we've seen from Cardiff since the plane crash.
All getting a bit silly now surely? How does anyone know if Cardiff would have stayed up had this poor guy not died and played! Emiliano Sala: Cardiff begin court action against Nantes
How they can claim damage to their reputation, is beyond me. The only thing that’s damaged their reputation is how they’ve handled this whole sad episode.
